We respect your privacy. This policy explains what personal information we collect, why we collect it, how we use and protect it, and the choices you have. We handle personal information in line with the Australian Privacy Principles (APPs) set out in the Privacy Act 1988 (Cth).
1. Who we are
Payback Creative (“Payback Creative”, “we”, “us” or “our”) is an Australian sole trader based in Perth, Western Australia, ABN 41 414 221 265. We produce advertising creative and generate sales enquiries for Australian businesses.
2. What this policy covers
This policy applies to all personal information we collect, including through:
- our website at paybackcreativeau.com;
- advertisements and instant lead forms we run on Facebook and Instagram (Meta) and other advertising platforms;
- enquiry forms, booking pages, phone calls, SMS and email; and
- our dealings with clients, prospective clients and suppliers.
It does not apply to third-party websites or platforms we link to or advertise on. Those operators have their own privacy policies.
3. What personal information we collect
Information you give us
When you submit an enquiry form on our website, complete an instant lead form in one of our Facebook or Instagram ads, or contact us directly, we may collect:
- your name;
- your business or trading name;
- your email address;
- your phone number;
- your industry or the type of work your business does;
- your postcode, suburb or service area;
- any details you choose to include in a message, call or booking; and
- records of our correspondence with you.
Information collected automatically
When you visit our website or interact with our ads, we and our advertising partners may collect technical information such as your IP address, approximate location, device and browser type, the pages you viewed, the ad or link that referred you, and the date and time of your visit. This is collected using cookies and similar technologies (see section 8).
We do not deliberately collect sensitive information (such as health, financial account or government identifier details) and we ask that you do not send it to us.
4. How we collect it
Wherever possible we collect personal information directly from you — when you fill in a form, book a call, email us, message us on social media, or speak with us on the phone.
Meta (Facebook and Instagram) lead forms. If you submit one of our instant lead forms on Facebook or Instagram, Meta collects the details you confirm in that form and passes them to us so we can respond to your enquiry. Meta may pre-fill some fields from your Facebook or Instagram profile. Meta’s own handling of your information is governed by Meta’s Privacy Policy, not this one.
We may also collect information from publicly available sources, such as a business website or public business listing, where it is reasonably necessary for the services we provide.
5. Why we collect it and how we use it
We use personal information to:
- respond to your enquiry and answer your questions;
- contact you by email, phone or SMS about the services you enquired about;
- prepare and provide quotes, proposals and bookings;
- deliver, manage and improve our services to you or to the client whose advertising we run;
- pass qualified enquiries to the relevant client business where you have submitted an enquiry through an advertisement we run for that business;
- measure how our advertising performs and improve future advertising;
- keep business, accounting and correspondence records; and
- meet our legal and regulatory obligations.
Where you have submitted an enquiry through an advertisement we run on behalf of a client business, you should expect that business to contact you directly about your enquiry. That business handles your information under its own privacy policy.
6. Marketing and how to opt out
If you contact us or submit an enquiry, we may follow up by email, phone or SMS about the services you asked about and, from time to time, about related services that may be useful to you. We do this consistently with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth).
You can opt out at any time by replying “STOP” to an SMS, using the unsubscribe link in an email, telling us on a call, or emailing hello@paybackcreativeau.com. We will action your request promptly. We may still need to contact you about an active enquiry, quote or engagement.
7. Who we share it with
We do not sell your personal information. We share it only where it is necessary, including with:
- The client business your enquiry relates to — where you submitted an enquiry through an ad we run for that business, so it can contact you;
- Our customer relationship and messaging platform — GoHighLevel (LeadConnector), which stores enquiry details and sends our emails and SMS;
- Advertising platforms — Meta Platforms, Inc. (Facebook and Instagram) and similar platforms we use to run and measure advertising;
- Website, hosting, form and analytics providers that operate our website and record enquiries;
- Professional advisers, such as our accountant, where reasonably required; and
- Law enforcement or government bodies, where we are required or authorised by law to do so.
We take reasonable steps to ensure our service providers handle your information appropriately and only for the purposes we engage them for.
8. Cookies, the Meta Pixel and tracking
Our website uses cookies and similar technologies, including the Meta Pixel. These help us understand how visitors use the site, measure whether our advertising is working, and show relevant ads to people who have visited our website.
You can control cookies through your browser settings, including blocking or deleting them. You can also manage the ads you see and how your activity is used through your Facebook and Instagram ad settings, and through your device’s advertising controls. Blocking cookies may affect how parts of our website work.
9. Overseas disclosure
Some of the providers we use store or process information on servers outside Australia, including in the United States — for example GoHighLevel (LeadConnector) and Meta Platforms, Inc. By providing your information to us, you consent to it being stored and processed overseas by these providers. We take reasonable steps to use reputable providers with appropriate data protection practices.
10. How we store and protect your information
We store personal information in password-protected accounts with our software providers and take reasonable steps to protect it from misuse, interference, loss, and unauthorised access, modification or disclosure. Access is limited to people who need it to do their job.
No method of transmission or storage over the internet is completely secure. While we take reasonable steps to protect your information, we cannot guarantee absolute security. If a data breach occurs that is likely to result in serious harm, we will respond in accordance with the Notifiable Data Breaches scheme.
11. How long we keep it
We keep personal information only for as long as we need it for the purposes described in this policy, or for as long as we are required to keep it by law (for example, tax and business records). When we no longer need it, we take reasonable steps to delete it or de-identify it.
12. Accessing, correcting or deleting your information
You can ask us to:
- give you access to the personal information we hold about you;
- correct information that is inaccurate, out of date or incomplete; or
- delete your information, where we are not required to keep it.
Email hello@paybackcreativeau.com with your request. We may need to verify your identity first. We will respond within a reasonable time, usually within 30 days. Access is free; if a request takes significant work we will tell you about any cost before we proceed. If we refuse a request, we will explain why in writing.
13. Complaints
If you believe we have mishandled your personal information, email hello@paybackcreativeau.com with the details. We will acknowledge your complaint and aim to respond within 30 days.
If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.
14. Third-party links
Our website, ads and emails may link to third-party websites and platforms. We are not responsible for their content or privacy practices. We encourage you to read the privacy policy of any website you visit.
15. Children
Our services are directed at businesses and are not intended for people under 18. We do not knowingly collect personal information from children. If you believe we have, contact us and we will delete it.

We may update this policy from time to time to reflect changes to our services, technology or the law. The current version is always the one published on this page and is identified by the “Last updated” date at the top. Please check back periodically.
